      民法典背景下如何做好不动产抵押物的转移登记

        【摘要】《民法典》在《物权法》基础上对不动产抵押规定做了些修改,其中最大的修正在于抵押期间,抵押人可以转让 抵押财产,而无需取得抵押权人同意。《民法典》实施距今已有 1 年多时间,笔者在调查了解之后,发现全国各地不动产 登记机构对该条款多持观望态度,有文章观点对《民法典》的新变化表示无需应对,而银行金融机构早已闻风而动采取规 避措施堵上了“漏洞”,导致《民法典》的实施并没有发挥“法与时转则治”的效果。如何理解《民法典》对不动产抵押 条款的调整,如何根据调整而做好不动产登记,如何发挥因调整给经济社会带来的积极作用,本文从登记机构、银行金融 机构、社会公众等视角,从法理、实操及意义上进行了探讨。

        【Abstract】On the basis of the Property Law, the Civil Code has made some modifications to the provisions of real estate mortgage, among which the biggest amendment is that during the mortgage period, the mortgagor can transfer the mortgaged property without obtaining the mortgagee's consent.It has been more than a year since the implementation of the Civil Code. After investigation and understanding, the author found that the real estate registration agencies across the country mostly hold a wait-and-see attitude towards this clause, Some articles have expressed the need not to deal with the new changes in the Civil Code,And banks and financial institutions have already taken measures to avoid the "loophole",As a result, the implementation of the Civil Code did not play the effect of "law and time change, rule".How to understand the adjustment of the real estate mortgage clause in the Civil Code, how to do a good job of real estate registration according to the adjustment, and how to play the positive role brought by the adjustment to the economy and society.This ARTICLE from the registration institutions, banks and financial institutions, the public and other perspectives, from the legal theory, practice and significance of the discussion.
